To promote actual estate in Florida, a person must have a license from the Florida Department of Enterprise and Professional Regulation. (2) Any individual, company, partnership, trust, joint venture, or different entity which sells, exchanges, or leases its personal actual property; nevertheless, this exemption shall not be accessible if and to the extent that an agent, employee, or unbiased contractor paid a commission or different compensation strictly on a transactional foundation is employed to make sales, exchanges, or leases to or with prospects within the extraordinary course of an owner’s enterprise of promoting, exchanging, or leasing actual property to the general public.

(c) A person who has been licensed as an actual property gross sales associate in Florida during the previous 5 years will not be licensed as a real property broker until, along with the other requirements of law, he or she has accomplished the gross sales affiliate postlicensure academic necessities, if these requirements have been prescribed by the fee pursuant to paragraph (three)(a).

(r) Has failed in any written itemizing settlement to include a definite expiration date, description of the property, worth and terms, price or commission, and a correct signature of the principal(s); and has failed to present the principal(s) a legible, signed, true and correct copy of the itemizing agreement within 24 hours of obtaining the written listing settlement.

(2) For the aim of performing its obligation underneath subsection (1) to teach individuals holding a license or permit, the fee may conduct, supply, sponsor, prescribe, or approve real estate instructional programs for all individuals licensed or permitted by the division as brokers, dealer associates, sales associates, or instructors; and the price and expense of such programs shall be paid as provided in s. 475.125.

(three) The fee may also publish and sell, at a reasonable price supposed to cover costs, a handbook on this chapter and other publications meant to be textbooks or guidelines for examine and steerage of students, applicants, licensees, certificateholders, and permitholders, and members of most of the people, copyright of which shall be the property of the state.
